The Equal Rights Amendment Can’t Be Defeated by Anti-Trans Scare Tactics

In this op-ed, Virginia State Delegate Danica Roem and human rights attorney Kate Kelly explain why the Equal Rights Amendment — as ratified by Virginia this week — is a gender-inclusive document.

“Sullivan, a noted constitutional scholar who has argued cases before the Supreme Court, went through the legal arguments. “The ERA will prohibit discrimination on the basis of sex,” she said. “If there’s discrimination against LGBTQ people on the basis of sex, then it’ll be covered. I believe the textual reading of the amendment does apply to sexual orientation and gender identity.”…

“In order to oppose the ERA, contemporary groups are using the classic tactic of pitting different groups of women against each other. There’s just one catch: While this tactic helped stymie ratification of the ERA in the past, we’re not falling for it this time. Modern feminists know we can’t win our rights by throwing the most vulnerable people under the bus. We won’t repeat the mistakes of the white suffragists who left out many women in the name of “strategy.”
